Terms and Conditions

These Terms and Conditions govern your use of kainosplay.com (the “Website”) and any inquiries, reservations, purchases, or bookings made through the Website.

In these Terms, “Kainos,” “Kainos Play,” “we,” “us,” and “our” refer to Kainos Play. “You” and “your” refer to anyone who accesses the Website or makes a purchase, reservation, or booking with us.

By using the Website or completing a booking, you agree to these Terms. If you do not agree, please do not use the Website.

2. Website information

We work to keep the information on the Website accurate and current. However, hours, availability, attractions, packages, prices, promotions, and other details may change.

Information on the Website is provided for general information and does not guarantee that a particular attraction, service, date, or time will be available.

If Website information conflicts with a written booking confirmation or signed agreement from Kainos, the booking confirmation or signed agreement will apply to that booking.

3. Eligibility and adult responsibility

You must be at least 18 years old and legally capable of entering into an agreement to make a booking or purchase through the Website.

When making arrangements for a child, you confirm that you are the child’s parent or legal guardian or have permission from their parent or legal guardian to do so.

Children must remain under the supervision of a responsible adult while at Kainos unless we have expressly agreed otherwise in writing. Kainos is an indoor playground and is not a daycare or child-minding service.

4. Admission and facility access

Admission is subject to:

• Posted capacity limits
• Facility hours
• Age, height, weight, or ability restrictions applicable to particular equipment
• Completion of any required waiver
• Compliance with posted rules and staff instructions
• Payment of the applicable admission price

Admission does not guarantee that every attraction or piece of equipment will be available throughout your visit. Equipment may be closed for cleaning, maintenance, inspection, safety, private events, or other operational reasons.

We may refuse admission or require a guest to leave if their conduct creates a safety risk, disrupts other guests, damages property, or violates these Terms, facility rules, or staff instructions. Refunds are not guaranteed when removal results from a guest’s conduct.

5. Supervision, safety, and waivers

Indoor play and climbing activities involve physical activity and inherent risks, including slips, falls, collisions, and contact with equipment or other guests.

Adults are responsible for:

• Actively supervising the children in their care
• Deciding whether an activity is appropriate for each child
• Following posted safety rules and staff instructions
• Making Kainos aware of relevant medical, mobility, or accessibility needs
• Ensuring each participating child has a completed waiver when required

A separate participant waiver may be required before entry or participation. These Website Terms do not replace that waiver.

Guests must use equipment only as intended. Running in restricted areas, unsafe play, bullying, fighting, deliberate damage, and ignoring staff instructions are not permitted.

6. Health and illness

Please do not visit Kainos if you or a child in your care is experiencing a contagious illness or symptoms that could place other guests or staff at risk.

You are responsible for deciding whether you or a child in your care is medically able to participate. Kainos staff do not provide medical advice.

In an emergency, you authorize Kainos to contact emergency services. You remain responsible for any resulting medical or transportation costs to the extent permitted by law.

7. Food and allergies

Guests must tell us about known allergies or dietary requirements when placing a food order or arranging an event.

Although we will consider the information provided, Kainos is not an allergen-free facility and cannot guarantee that food, preparation areas, equipment, or surfaces will be free from allergens or cross-contact.

Outside food and beverages may be restricted except where approved by Kainos or required for medical or infant-feeding reasons.

8. Prices and payment

Prices are shown in Canadian dollars unless stated otherwise. Applicable taxes and any additional charges will be identified before payment or included in your booking confirmation.

Prices, packages, and promotions may change. A change will not affect a confirmed booking unless you request a change to that booking or both parties agree otherwise.

A booking is not confirmed until we receive any required information and deposit or payment and send you confirmation.

You are responsible for providing complete and accurate contact, attendance, and payment information.

9. Parties and private bookings

Party and private-booking inclusions, attendance limits, additional-guest charges, food options, and timing are described on the Website or in the applicable booking confirmation.

For birthday-party bookings:

• A $100 deposit is required within 24 hours to reserve the selected date and time.
• The deposit is applied to the final booking total.
• The remaining balance is due before the event begins.
• A completed waiver is required for every participating child.
• The final guest count must be provided at least 72 hours before the event.
• Additional guests are subject to the applicable additional-child charge and facility capacity.
• The host may arrive 10–15 minutes before the scheduled start time.
• Late arrival does not extend the scheduled booking.
• Confetti, glitter, and other unusually difficult-to-clean decorations are not permitted.

Additional or customized requirements must be approved by Kainos in writing and may result in additional charges.

10. Cancellations and rescheduling

Party deposits are non-refundable, subject to any rights you may have under applicable law.

If you request a change:

• More than 14 days before the booking: We may allow the deposit to be transferred to a new date, subject to availability.
• Between 7 and 14 days before the booking: The deposit will be forfeited, although we may offer a one-time rescheduling option.
• Within 48 hours of the booking: The deposit and any prepaid costs that Kainos cannot recover will be forfeited.

When offered, a date change is limited to one rescheduling and the new event will generally need to take place within 90 days of the original date.

Any rescheduling option is subject to availability and written confirmation from Kainos.

If Kainos must cancel a confirmed booking, we will offer a reasonable alternative date or refund the amount paid for the cancelled booking, unless another remedy is agreed upon.

11. Promotions

Promotions, discounts, and special offers may have separate eligibility requirements, dates, exclusions, or redemption instructions.

Unless an offer expressly says otherwise:

• Promotions cannot be combined
• Promotions have no cash value
• Promotions cannot be applied retroactively
• Availability may be limited
• Altered, duplicated, transferred, or improperly obtained offers may be refused

The terms displayed with a promotion form part of these Terms.

12. Website use

You may use the Website only for lawful, personal purposes.

You must not:

• Interfere with the Website or its security
• Attempt to gain unauthorized access to any account, system, or information
• Introduce malicious code or automated traffic
• Scrape, copy, or republish Website content for commercial use without permission
• Submit false, misleading, abusive, or unlawful information
• Impersonate another person
• Use the Website in a way that infringes another person’s rights

We may restrict access to the Website where reasonably necessary to protect Kainos, our guests, or our systems.

13. Intellectual property

The Website and its text, photographs, graphics, branding, logos, videos, layout, and other content belong to Kainos or are used with permission.

You may view and temporarily download Website content for personal, non-commercial use. You may not reproduce, modify, distribute, sell, license, or commercially exploit it without prior written permission.

“Kainos Play” and associated branding may not be used in a way that suggests sponsorship, endorsement, or affiliation without our written permission.

14. Messages and submitted material

When you contact us through the Website, you are responsible for ensuring that the information you provide is accurate and that you have the right to provide it.

Sending an inquiry does not create or confirm a booking. A booking is confirmed only when Kainos sends written confirmation.

Please do not submit confidential, unlawful, infringing, or inappropriate material through the Website.

15. Email communications

If you sign up for news, offers, or updates, we may send you electronic messages in accordance with your consent and applicable Canadian law.

You may unsubscribe from promotional messages using the unsubscribe link in the message or by contacting us. You may still receive transactional messages relating to an inquiry, purchase, waiver, or booking.

16. Third-party services and links

The Website may link to third-party websites or use third-party services for maps, bookings, payments, forms, or social media.

Third parties operate under their own terms and privacy practices. Kainos is not responsible for third-party websites, services, availability, security, or content.

17. Website availability and disclaimers

We do not guarantee that the Website will always be available, secure, uninterrupted, or free of errors.

To the fullest extent permitted by law, the Website and its content are provided on an “as available” basis without warranties that are not expressly stated in these Terms.

Nothing in these Terms excludes a warranty, right, or remedy that cannot legally be excluded under Ontario consumer-protection law.

18. Limitation of liability

To the fullest extent permitted by law, Kainos will not be liable for indirect, incidental, special, or consequential losses arising solely from your use of, or inability to use, the Website.

Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, wilful misconduct, or any statutory consumer right that applies despite an agreement to the contrary.

Liability connected with physical participation at Kainos may also be addressed in the participant waiver or a separate booking agreement.

19. Privacy

Our collection, use, and handling of personal information are governed by our Privacy Policy.

By submitting information through the Website, you confirm that you have reviewed the Privacy Policy and have authority to provide any personal information submitted on behalf of another person.

20. Changes to these Terms

We may update these Terms when our Website, services, or legal obligations change.

The revised Terms will be posted on the Website with a new effective date. Changes apply from that date and will not retroactively alter a confirmed booking unless required by law or agreed to by both parties.

21. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.

Any dispute will be handled by a court with jurisdiction in Ontario, subject to any rights or procedures available to consumers under applicable law.

22. General terms

If part of these Terms is found to be invalid or unenforceable, the remaining parts will continue to apply.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

These Terms, together with any applicable booking confirmation, facility rules, participant waiver, Privacy Policy, and written agreement, form the agreement that applies to your use of the Website and the relevant service.
